Welcome to The Trusty Handyman. By accessing and using our website and services, you agree to comply with and be bound by the following Terms & Conditions. Please read them carefully.

Scope of Work: The Contractor shall provide services as agreed upon between the parties. The specific details of the services, including the nature, extent, and duration, will be determined on a case-by-case basis and specified in a separate agreement or work order.

Termination: Either party may terminate this contract at any time by providing written notice to the other party. In the event of termination by the Owner, the Contractor shall be entitled to payment for the work completed up to the date of termination, including any applicable costs and expenses incurred.

Change Orders: Any changes or modifications to the scope of work must be agreed upon in writing by both parties. The terms and conditions regarding change orders, including the process for requesting changes and any associated costs, will be specified in a separate agreement or work order.

Payment Terms: The payment terms shall be agreed upon in each specific case and specified in a separate agreement or work order. The Contractor may request a deposit or advance payment before commencing the work. The remaining balance shall be paid upon completion of the services or as otherwise agreed upon.

Credit and Collections: In the event of non-payment within the agreed-upon terms, the Contractor reserves the right to pursue appropriate legal remedies to recover the outstanding amount. The Owner shall be responsible for any costs incurred in the collection process, including attorney’s fees and court costs.

Access to Property: The Owner shall provide reasonable access to the property for the Contractor to perform the services without delay. The Owner authorizes the use of necessary utilities, such as electricity, water, gas, or oil, during the course of the work. If the Owner vacates the property during the work, arrangements shall be made to allow the Contractor to inspect the property as needed.

Liability and Damages: The Contractor assumes no responsibility for any consequential damages, including but not limited to landscaping, driveways, walkways, or damages resulting from water infiltration or freezing during the course of the work. The Contractor’s liability for any claims of missing or damaged personal property shall be limited to a maximum aggregate amount of $250.00 per contract.

Supervision: The Contractor shall provide adequate supervision to ensure the quality, direction, and safety of the work. The Owner is encouraged to be available for on-site discussions and approvals when necessary. In the absence of the Owner, the Contractor is authorized to make decisions to avoid project delays.

Pets: The Owner is responsible for ensuring the safety and control of any pets on or near the property during the Contractor’s work. The Owner shall take necessary measures to contain and protect pets, including removing them from work areas as required. The Contractor assumes no liability for any injury, death, or loss of pets.

Working Hours: Normal working hours for the Contractor are Monday through Saturday, from 8:00 AM to 5:00 PM. Any work, meetings, discussions, or consultations outside of these hours may result in additional charges to the Owner.

Warranty: Unless otherwise specified in a separate warranty agreement, no warranty, either expressed or implied, is provided by the Contractor for its services. Any claims for defective workmanship must be reported in writing to the Contractor’s office within a reasonable time. The Contractor reserves the exclusive right to rectify any defects within 60 days of receiving the notice, provided reasonable access is granted.

– Labor Warranty: The Contractor warrants the quality of its workmanship for a period of 1 year from the completion date, excluding repair work. Any defects must be reported in writing within this period to be eligible for correction.

– Repairs: Due to the nature of repair work, no warranty is offered on repairs, unless otherwise stated in writing. Repairs often involve existing conditions that are beyond the Contractor’s control and may affect results over time.

– Materials Provided by Contractor: We warrant materials we supply for a period of 90 days, or in accordance with the manufacturer’s warranty, whichever is longer. Warranty claims require proof of defect and allow us the right to inspect or replace the product.

– Materials Provided by Customer: No warranty is provided for materials not purchased or supplied by the Contractor. The Contractor is not responsible for delays, failures, or defects resulting from customer-provided materials.

Warranty Limitations:

– Warranty does not cover damage caused by misuse, neglect, normal wear and tear, accidents, environmental conditions, or unauthorized repairs.

– The warranty is void if another contractor or individual modifies, alters, or attempts to repair the work.

– This warranty is limited to repair or replacement only. Refunds will not be issued in lieu of repairs.

Entire Agreement: This contract constitutes the entire agreement between the parties and supersedes any prior discussions, negotiations, or agreements, whether written or verbal, relating to the subject matter herein.

Cancellation Policy: Customers must cancel 24 hours before the scheduled service day, and it needs to be notified to the sales rep or coordinator. Cancellation fees range from 10% – 20% of the service cost. No rescheduling fee will be charged for timely requests, subject to availability.

Materials Purchase policy: We offer the option to purchase materials on behalf of our customers. A handling fee, ranging from 20% – 35% of the total material cost, will be applied to cover procurement and logistics. Customers can also choose to provide materials themselves to avoid this fee.

Exterior Work and Landscaping: we are responsible for any minor disturbance or damage to landscaping, including grass, plants, soil, or surrounding exterior areas, resulting from normal access, movement of personnel, equipment, or materials required to perform the work.
